Terms & Policies

 

General Policy:

The client is asked not to sell the pictures, nor to modify or edit them without the photographer prior consent.All products left in the photographer possession for more than two months without any news from the seller won’t be returned and will be disposed of.

Payment Policy:

A retainer of 40% of total amount will be made and the invoice will be signed by both parties to make the Terms and Conditions effective. At the time the contracts take effect, Marion Botella Photography shall reserve the date and time agreed upon, and not make any other reservations or accept any other clients for said date and time. For this reason, in the event that the client cancels the contract for any reason under 20 days before the shooting, all monies paid shall be retained by Marion Botella Photography in order to offset its loss of business. Full payment is due before the edited pictures are sent over. If the payment is not made within the limit of 20 days after reception of the invoice, late fees of 2£ per day will be applied.

Refund Policy:

Due to the nature of custom photography, all sales are final. Marion Botella Photography does, of course, guarantee that the pictures you receive meet the highest standards in every respect and works with the customers to approve designs and custom work before orders are placed and that it matches the work/ portfolio of Marion Botella Photography. Due to the nature of digital photography and the fact that photographs, once sent, cannot be returned, Marion Botella Photography has a strict NO REFUNDS POLICY. Pictures are sent through contact sheet to allow the client to make the selection of pictures to be edited. Once a transaction has been completed (i.e., the buyer selected and purchase an incorrect photo) the client must notify Marion Botella Photography right away, before receiving the «incorrect» photograph edited. Refunds will NOT be given due to «not liking a photo», selecting an incorrect photo after the buyer has already received the photograph, or any other reason.

Distribution rights:

Distribution rights are given to the client for every picture, this means that once the client has signed the invoice (i.e. agreed to the T&Cs) and entirely paid the invoice, they’re free to use the pictures for all promoting purpose, on their website, e-shop or/and social media. If the client wants to send the pictures to another media (magazine, blogger, anything «outside the brand»...) they will have to credit the photographer or give watermarked pictures provided by the photographer on request. Copyright remains the exclusive property of Marion Botella photography, unless stated otherwise. If any breach of contract or infringment of copyright occurs, a fee matching the damages and loss of income will be applied, if the fee is not settled, legal actions will be taken.
